A lawsuit has been filed against Universal City Development Partners, Ltd., the operator of Universal Orlando Resort, over a slip-and-fall incident that allegedly occurred at the Volcano Bay water park on July 11, 2025.

The lawsuit, initiated on Wednesday, September 24, 2025, claims that Joshua De La Cruz suffered a serious injury after visiting the restroom following a ride on the Ko’okiri Body Plunge waterslide. According to the complaint, De La Cruz entered the restroom, where he “encountered the dangerous and hazardous condition of excessive water on the floor,” causing him to “slip and fall.”
The filing states that De La Cruz “hit his head, was knocked unconscious, and woke up in a pool of his blood.” He was transported by ambulance to the emergency room, where he was diagnosed with a “significant brain bleed.” Due to the incident, De La Cruz “suffered bodily injury with resulting pain and suffering, disability, disfigurement, mental anguish, inconvenience, loss of capacity for the enjoyment of life, expense of hospitalization, medical and nursing care and treatment in the past and in the future, loss of earnings, loss of ability to earn money, and aggravation of a previously existing condition.” The lawsuit claims that these losses are either permanent or continuing in nature.
The complaint alleges that Universal negligently failed to provide a safe and non-slippery bathroom floor, failed to mark the hazard of a slippery floor, failed to dry the wet floor, and failed to warn De La Cruz of the hazardous condition, among other allegations.
De La Cruz is seeking damages exceeding $50 million.
