A Kentucky woman has filed a lawsuit against Walt Disney Parks and Resorts, alleging she was seriously injured after tripping and falling over an embedded track at Magic Kingdom in October 2025.

The complaint, filed in Orange County Circuit Court, was brought by Rhonda Smith, a resident of Frankfort, Kentucky. Smith is seeking damages exceeding $50,000.

According to the lawsuit, the incident occurred on October 24, 2025, at approximately 5:00 p.m. while Smith was near the Cinderella Castle and Main Street, U.S.A. area at Magic Kingdom.

The lawsuit states that the pedestrian walkway in that area contains steel rails and flangeways for the trolley track that create changes in level, edges, and gaps where the rail meets the surrounding ground. The complaint claims the area lacked adequate safety measures, including warnings, cones, stanchions, guardrails, or other protections, particularly during nighttime conditions and parade-related crowd congestion.

Smith alleges that as she walked through the area, her foot caught on or in the embedded track or adjacent paver interface, causing her to trip and fall.

The complaint says that Disney “breached its duties” by failing to maintain safe walking conditions, allowing tripping hazards such as uneven surfaces and gaps to exist, not taking timely action to inspect or correct hazardous conditions, and failing to warn of these hazards, among other allegations.

As a result of the fall, Smith claims she suffered a permanent bodily injury along with physical pain, mental anguish, disability, loss of enjoyment of life, and aggravation of a pre-existing condition, as well as other conditions.
